I really like all of your thoughts here, except for the point about an artist not wanting her music played at a Santorum rally.
You say an artist should have control over the distribution of their work; I agree. But after the work is distributed, and the artist is pleased with how that distribution took place, the artist doesn’t have control on how it’s used.
For instance, I have a copy of TFioS sitting on my shelf. If I wanted to paint over each page with taupe paint, I could. It would be foolish and stupid, but I could because it is my copy of TFioS. You wrote it, but I underwent and exchange with you (via Amazon) and gave you money for it so I would have the right to do whatever I want with it.
Same with the music at a Santorum rally. As terrible as I think he is, if he obtained music legally, and he’s not making monetary profit of off playing an artist’s song, he can do whatever he wants with it. Because he bought that right.
